Government of Karnataka vide Notification No: OE 98 PCE 2023 Dated: 25.08.2023 and 06.10.2023 in the background of .D.Kempanna, President, Karnataka State Contractor Association having addressed letters of appeal to the Hon’ble Prime Minister and the earlier Hon’ble Chief Ministerof the alleged bribery/corruption of more than 40% in the departments carrying out major works in the State, the package system, release of dues and tender process, etc., ordered an inquiry into the allegations in the petition filed by the Karnataka State Contractors Association, Bengaluru under the Commission of Inquiry Act, 1952(Central Act LX of 1952) rule no:03and sub rule no:01 of the act ,the Government has appointed the Commission of Inquiry under the leadership of Hon’ble Justice H.N. Nagamohan Das. Firstly, this inquiry commission will investigate the works carried out during the period from 26.07.2019 to 31.03.2023.
It is in this background that the Commission of Inquiry has been entrusted with the following terms of references:
Tender process, package procedure, re-estimation in departments that carry out large amount of works like Public Works Department, Water Resources Department, Urban Development Department, Rural Development and Panchayat Raj Department and minor irrigation departments, release of due amount etc., a detailed investigation will be conducted with verification of location and documents, complete investigation with information of commissions and clear identification of the accused concerned.
In addition to the above scope of work, the Commission will also examine all aspects of the petitions/complaints of the President, Karnataka State Contractors Association in detail within the scope of investigation.
Also, the following important points will also be reviewed in the scope of the investigation.
• Regarding granting administrative approval to the project / works as per rules.
• Quality of works / projects implemented.
• Is the quantity (minimum) in the works estimate realistic or artificially inflated? Examining whether raises, their amount and financial commitment along with the stage at which raises are raised.
• Inevitability and necessity of additional variance incurred during execution of works; If necessary, the reasons for dropping from the original estimate and approval of the same by the competent authority.
• Has the bill been paid without performing any works or has the bill been paid in excess of the quantity of works executed?
• Regarding the factors whether the conditions were formulated to favor a few contractors while inviting the tenders for these works and prevent the remaining contractors from participating in the tender process.
• Is quality testing of materials, equipment etc. done by specified authorized agencies before starting work?
• Any other lapses which may have arisen in the tendering process and implementation processes for the overall works.
• Any other serious matters brought to the notice of the Commission during the course of review shall be reviewed by the Commission of Inquiry.
